1. Agreement to Terms

By accessing and using the services provided by BrightParty Kids ("we," "our," or "us"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and BrightParty Kids. If you do not agree to these terms, please do not use our services or website.

We reserve the right to modify these terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications indicates your acceptance of the updated terms.

2. Service Description

BrightParty Kids provides professional children's event planning and organization services, including but not limited to birthday parties, themed events, entertainment coordination, venue decoration, catering arrangements, and photography services. All services are subject to availability and must be booked in advance.

We strive to provide accurate descriptions of our services, but we reserve the right to modify service offerings, pricing, and availability without prior notice. Any significant changes to booked services will be communicated to clients as soon as possible.

3. Booking and Payment Terms

To secure a booking, clients must provide a non-refundable deposit of 30% of the total event cost. The remaining balance is due no later than 7 days before the scheduled event date. Failure to make timely payments may result in cancellation of your booking.

All prices are quoted in Australian Dollars (AUD) and include GST unless otherwise stated. Additional charges may apply for services requested outside our standard packages, travel beyond our service area, or last-minute changes to event details.

Accepted payment methods include credit cards, debit cards, bank transfers, and approved payment platforms. All payments are processed securely, and we do not store complete credit card information on our servers.

4. Cancellation and Refund Policy

Cancellations made more than 30 days before the event date will receive a full refund minus the initial deposit. Cancellations made 15-30 days before the event will receive a 50% refund. Cancellations made less than 15 days before the event are non-refundable.

In cases of extreme weather, natural disasters, or other circumstances beyond our control, we will work with clients to reschedule events when possible. If rescheduling is not feasible, refunds will be provided at our discretion based on costs already incurred.

5. Client Responsibilities

Clients are responsible for providing accurate information regarding guest count, dietary restrictions, special needs, venue access, and any other relevant details. Changes to this information must be communicated at least 7 days before the event.

Clients must ensure that the venue (if not provided by us) is suitable and accessible for our team and equipment. Any damages to our equipment or materials caused by venue conditions or guest behavior may be charged to the client.

Parents or guardians must remain present throughout the event and are responsible for the safety and behavior of all children attending. While our staff maintains professional supervision, ultimate responsibility for child safety rests with parents and guardians.

6. Liability and Insurance

BrightParty Kids maintains comprehensive liability insurance for all events. However, we are not liable for injuries, accidents, or losses resulting from guest behavior, pre-existing venue conditions, or circumstances beyond our reasonable control.

Our maximum liability for any claim related to our services is limited to the total amount paid for the specific event in question. We are not responsible for indirect, consequential, or punitive damages.

All equipment and materials provided remain the property of BrightParty Kids. Clients are liable for any damage, loss, or theft of our property during events and will be charged replacement costs.

7. Intellectual Property

All content on our website, including text, images, logos, designs, and multimedia materials, is the intellectual property of BrightParty Kids and protected by copyright laws. Unauthorized use, reproduction, or distribution is prohibited.

Photographs and videos taken during events may be used by BrightParty Kids for marketing purposes unless clients explicitly opt out in writing. Clients who wish to maintain complete privacy of event media must notify us before the event.

8. Privacy and Data Protection

We collect and process personal information in accordance with our Privacy Policy and Australian privacy laws. Client information is used solely for service delivery, communication, and improvement of our offerings.

We do not sell, rent, or share client information with third parties except as necessary to fulfill our services (e.g., catering partners, entertainers) or as required by law. For detailed information, please review our Privacy Policy.

9. Force Majeure

BrightParty Kids is not liable for failure to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government restrictions, pandemics, labor disputes, equipment failures, or supplier issues.

In such cases, we will make reasonable efforts to notify clients promptly and work toward alternative solutions, including rescheduling or partial refunds based on services not rendered.

10. Dispute Resolution

Any disputes arising from these terms or our services will first be addressed through good-faith negotiations between both parties. If resolution cannot be reached, disputes will be subject to mediation before pursuing legal action.

These terms are governed by the laws of Victoria, Australia. Any legal proceedings must be conducted in the appropriate courts of Melbourne, Victoria.

11. Modifications to Services

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time. Existing bookings will be honored according to the terms agreed upon at the time of booking, but future availability is not guaranteed.
